Eligibility

You must be legally capable of entering into these Terms under applicable law. If you are below the age of legal majority where you live, you should use the Services only with the consent and supervision of a parent or legal guardian where required by law. You may not use the Services if applicable law prohibits you from doing so.

Accounts

Certain features may require you to create or access an account. You agree to:

• provide reasonably accurate information;
• protect your account and authentication credentials;
• not sell, rent, or transfer your account;
• not impersonate another person or entity;
• notify us if you become aware of unauthorized access to your account.

To the extent permitted by law, you are responsible for activities conducted through your account. We may permit authentication through Apple or other third-party authentication providers. Your use of those services may also be subject to the applicable third party’s terms.

License to Use the Game

FAULTINERA: COMMAND and its software, code, graphics, characters, units, buildings, maps, stories, music, audio, designs, names, and other content are owned by Yondera or applicable rights holders.

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Game for your personal, non-commercial entertainment purposes.

Except where expressly permitted by applicable law, you may not:

• copy or redistribute the Game;
• sell, rent, or sublicense the Game;
• modify the Game;
• decompile, disassemble, or reverse engineer the Game;
• attempt to derive source code;
• bypass technical protection or security mechanisms;
• access our systems or servers without authorization.

No ownership rights in the Game or its intellectual property are transferred to you.

Game Content and Digital Entitlements

The Game may offer maps, campaigns, faction content, DLC, features, and other digital content or entitlements. Unless expressly stated otherwise, these items represent licenses or digital entitlements to access Game content and do not constitute a transfer of ownership of the underlying software, artwork, design, or other intellectual property.

Purchases

Certain content may require payment. If you make a purchase through the Apple App Store, Google Play, or another authorized storefront:

• the applicable platform processes the transaction;
• payment methods are managed by that platform;
• applicable taxes may be determined by the platform;
• refunds are generally governed by the applicable storefront rules and mandatory consumer law.

We may verify transactions through purchase receipts or platform-server information and grant the corresponding entitlement to your account. You may not falsify transactions, falsify purchase receipts, circumvent payment mechanisms, or unlawfully copy, share, or transfer paid entitlements.

Restoring Purchases

Where supported by the applicable storefront and product type, we may provide purchase restoration functionality. Whether purchases can be transferred between platforms, accounts, or storefronts depends on the relevant product design and platform rules. Unless expressly stated in the Game, a purchase made on one platform should not be assumed to apply automatically to another platform.

Online and Offline Services

The Game may contain both locally available offline functionality and online services. Certain functions may depend on internet access, servers, account authentication, the current Game version, purchase verification, or multiplayer or matchmaking infrastructure.

We will use reasonable efforts to operate the Services but do not guarantee that online functionality will be permanent, uninterrupted, or error-free. Maintenance, technical upgrades, security incidents, internet failures, third-party platform issues, or circumstances outside our reasonable control may cause temporary interruptions.

Updates

We may issue updates to fix errors, improve performance, add features, adjust game balance, maintain security, or comply with law or platform requirements. Certain online functionality may require installation of a current version.

Game units, statistics, rules, maps, artificial intelligence, balance, interface design, and other gameplay characteristics may change over time.

Fair Play and Prohibited Conduct

You may not use the Services in a way that harms the Game, other players, or the integrity of the Services. Prohibited conduct includes:

• cheating software;
• unauthorized client modifications designed to create an unfair advantage;
• exploitation of bugs for improper benefit;
• bots or unauthorized automation;
• unauthorized modification of Game data;
• manipulation of server communications;
• purchase or entitlement fraud;
• attacks on or interference with the Services;
• unauthorized access to systems or accounts;
• distribution of malware;
• unlawful activity.

Nothing in these Terms restricts lawful security research or other activities that applicable law does not permit us to prohibit.

Anti-Cheat and Game Integrity

To protect the Game and our users, we may use reasonable technical measures to identify client tampering, abnormal gameplay, transaction fraud, abuse of the Services, and unauthorized access. Any related processing of personal information will be carried out in accordance with our Privacy Policy and applicable law.

Account Restrictions and Termination

If we reasonably determine that you have materially violated these Terms, engaged in cheating or fraud, created a security risk, infringed the rights of others, or engaged in unlawful conduct, we may take proportionate action, including warnings, temporary restrictions, suspension of features, account suspension, or account termination.

Nothing in this section limits rights available to you under mandatory consumer law.

Feedback

If you voluntarily provide us with suggestions, Game feedback, bug reports, ideas, or comments, you permit us to reasonably use that material to evaluate, maintain, and improve the Game. Personal information included in such submissions remains subject to our Privacy Policy.

Intellectual Property

FAULTINERA: COMMAND, including its name, trademarks, logos, fictional universe, game design, artwork, characters, units, buildings, maps, music, software, source and object code, data, and documentation, is protected by applicable copyright, trademark, and other intellectual property laws. All rights not expressly granted under these Terms are reserved by Yondera or the applicable rights holders.

Third-Party Platforms

If you obtain the Game through a third-party platform, you must also comply with the applicable terms of that platform. For applications obtained through the Apple App Store, applicable Apple Media Services terms and Apple’s standard Licensed Application End User License Agreement may also apply. Where platform terms are required by law or platform rules to prevail over conflicting provisions of these Terms, the applicable platform terms will control to that extent.

Third-Party Services

The Game may interact with third-party authentication services, app stores, network services, cloud services, or other technology services. Services independently controlled by third parties may be subject to their own terms and policies.

Changes to or Discontinuation of Services

As the Game evolves, we may add functionality, modify functionality, adjust content, replace technical infrastructure, or discontinue certain features. Where purchased digital content or mandatory consumer rights are affected, we will comply with applicable consumer protection law.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Game will always be free of errors, online services will never be interrupted, all devices will remain compatible, every defect will be corrected, or every Game feature will remain unchanged indefinitely.

Nothing in these Terms excludes or restricts statutory warranties or consumer rights that cannot lawfully be excluded or restricted.

Limitation of Liability

To the maximum extent permitted by applicable law, Yondera will not be liable for indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Services.

To the maximum extent permitted by law, Yondera’s aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid for the Services during the 12 months before the event giving rise to the claim and (b) USD 100.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including any liability for fraud, personal injury, or mandatory consumer protection obligations where applicable.

Indemnification

To the extent permitted by applicable law, you may be responsible for reasonable losses arising from third-party claims resulting from your material breach of these Terms, unlawful use of the Services, or infringement of another person’s rights. This provision does not transfer liability to consumers where such transfer is prohibited by law.

Governing Law

Except to the extent mandatory consumer protection law provides otherwise, these Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of the Hong Kong Special Administrative Region shall have non-exclusive jurisdiction over disputes relating to these Terms.

Nothing in this section deprives you of mandatory consumer protections available under the law of your habitual residence.

Changes to These Terms

We may update these Terms in response to changes in the Game, applicable law, security requirements, or our business or technical operations. Where a change materially affects users’ rights, we will provide reasonable notice where required. Your continued use of the Services may be subject to the updated Terms, except where applicable law requires separate consent.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

Entire Agreement

These Terms, our Privacy Policy, and any additional terms expressly applicable to a particular feature or platform constitute the agreement governing your use of the Services.
